The Australian Securities and Investments Commission (ASIC) has conducted a comprehensive review of the motor vehicle finance sector, uncovering significant concerns regarding lending practices.
This examination has highlighted issues such as exorbitant establishment fees and a troubling rate of early loan defaults, raising questions about the adequacy of current lending standards.

ASIC's investigation revealed that many lenders rely heavily on intermediaries, including brokers and dealerships, to facilitate car loans. This dependency has led to inconsistent oversight, with some lenders failing to conduct regular audits or implement robust checks on these third parties. Such lapses have resulted in problematic sales tactics that can adversely affect consumers.

One alarming finding from the review was the discovery of loan establishment fees reaching as high as $9,000 on a $49,000 loan. Additionally, nearly half of the consumers who defaulted on their car loans did so within the first six months, indicating potential issues with the initial assessment and approval processes.

In response to these findings, ASIC has outlined several recommendations aimed at enhancing consumer protection:

  • Implementing better training and accreditation processes for intermediaries to ensure they adhere to ethical sales practices.
  • Strengthening product review mechanisms and risk frameworks that utilize consumer harm indicators and available data, including internal and external dispute resolution information, to ensure products reach the appropriate target market.
  • Improving communication strategies when financial hardship arrangements are in place, including providing clearer information on voluntary surrender options.
  • Enhancing governance frameworks to ensure adequate oversight of intermediary brokers and dealers.

ASIC Commissioner Alan Kirkland emphasized the necessity for lenders to elevate their standards to protect consumers from potential financial harm. He stated that ASIC is prepared to take enforcement action where appropriate to safeguard consumer interests.

For consumers seeking car loans, it's crucial to be aware of these developments and to exercise due diligence when selecting a lender. Ensuring that the lender has transparent practices and reasonable fees can help mitigate the risks associated with car financing.
